The following Privacy Policy summarizes that various ways that Mooch,LLC, a Delaware limited liability company ("Mooch"), deals with the information you provide while using the Mooch website (the "Site") and the services offered onthe Site (the "Services").  We may need to change this Privacy Policy fromtime to time in order to address new issues and reflect changes on our site. All changes will be posted here.

This Privacy Policy is incorporated into and is subject to the Mooch Standard Terms and Conditions. Your use of the Site and any personal information you provide on the Site remain subject to the terms of this Privacy Policy and the Terms and Conditions.

Mooch has established registration and sign-in procedures which, in conjunction with this Privacy Policy, help ensure the privacy of information provided to Mooch by its visitors and members while using Mooch websites. You should be aware that this Privacy Policy applies only to the Mooch Site and Services, and not to any other websites you may visit before or after Mooch's Site.

Collection of Data

You can browse the Site without revealing any information about yourself.  Once you give us your personal information you are not anonymous to us. If you choose to provide us with personal information, you consent to the transfer and storage of that information on our servers. You may, of course, decline to submit personally identifiable information to the Site, in which case you will be unable to trade video games or other items on the Site, and we may not be able to provide other Services to you.  We may collect and store the following personally identifiable information (collectively "Data"): email address, physical contact information, shipping information, transaction information based on your activities on the Site, correspondence sent to the Site and correspondence sent from us.

The Mooch Services automatically collect usage information, such as the number and frequency of visitors to our site(s), the pages and content accessed, and the video games requested, offered, traded, reviewed, searched, bought or sold. Mooch uses this data in aggregate form, as a statistical measure, and not in a manner that would identify you personally.

We do not collect any credit card or banking information, and do not store such information on our systems. We provide you with the ability to pay for our Services through external payment processors, such as Paypal.  Credit card, banking, or account information that you provide to these processors is not shared with Mooch. We only receive confirmation for each payment and the data necessary to process the order.

Use of Data

Mooch understands how important privacy is to our members. We are committed to protecting your privacy and want to make sure that you understand how your membership information is used. We will not sell, rent or provide your personal information to third parties for marketing purposes or advertising agencies.

 

We may provide aggregate information to our partners and customers about how our users, collectively, use the Mooch Services. We share this type of statistical data so that our partners and customers also understand how and how often people use the Mooch Services. Mooch never discloses aggregate information to a partner or a customer in a manner that would identify you personally, without your explicit permission.

 

We will only disclose your Data in accordance with our Privacy Policy and/or with your explicit consent. We may use your Data to customize and improve your user experience on the Mooch Site. For the purpose of making the trading process possible, other users may view your contact information at times. After you make or accept an offer from our listings, your full name and mailing address will be given to the other user. At no time will your e-mail address be visible or given otherwise to other users or any other third parties. We let you change your personal information so that you can keep it up to date. This Policy does not apply to other entities that we do not own or control or persons that are not our employees, agents or within our control.

Further Disclosure

Your user ID will be displayed on various pages of the Site, and is therefore available to the public.  Your user rating, trading history and other activities on the Site will be identifiable by your user ID. Other people will be able to see items that you have traded in the past, comments, your postings on the Site and so on. Therefore, if you associate your name with your user ID, the people you have revealed your name to will be able to personally identify your activities. Although we have implemented security measures for the Site, others may attempt to automatically collect your email address from our Site. Changing your personal information is explained under Editing or Deleting Your Account Information. Further, we may send out notices to you or other members regarding suspicious activity or policy violations on the Site. We will disclose limited personal information to verified requests by law enforcement and government officials who conduct criminal investigations, and require a subpoena for additional personal information, in accordance with our Privacy Policy. Therefore, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, we can (and you authorized us to) disclose your name, city, state/province, telephone number, email address, user ID, history, fraud complaints, and swapping, catalogue orders and listing history without a subpoena. However, in an effort to balance your right to privacy and protect the Mooch community, we will not disclose additional information to law enforcement or other government officials without a subpoena, court order or substantially similar legal procedure, except when the additional disclosure of information is necessary to prevent imminent physical harm or financial loss. Further we can (and you authorize us to) disclose your name, street address, city, state/province, postal code, country, phone number, email and company name as we in our sole discretion believe necessary or appropriate in connection with an investigation or prosecution of any unlawful activity.

Some contests, sweepstakes and other promotions that will appear on the Mooch websites may also be sponsored by other companies. These companies may also seek to collect personal information from you. You can avoid providing your personal information to these companies and sponsors by not participating in these contests, sweepstakes or promotions. In any event, you are encouraged to make yourself familiar with the privacy policy specific to any such event prior to your agreement to participate.

Cookies

Like many web sites, we may set and use cookies to enhance your user experience, such as retaining your personal settings. Advertisements may appear on our Site and, if so, may set and access cookies on your computer and is subject to the privacy policy of those parties providing the advertisement. However, the companies serving the advertising do not have access to our cookies. Most cookies are "session cookies", meaning that they are automatically deleted from your hard drive at the end of a session. Children

We do not allow persons who are ages seventeen or younger to become members of this Site.

Editing or Deleting Your Account Information

We provide you with the ability to edit the information in your user account information that you provided to us in registration by using 'My Profile'. You may request deletion of your user account by contacting info@Mooch. Content or other data that you may have provided to us and that is not contained within your user account, such as posts that may appear within our forums, may continue to remain on our Site at our discretion even though your user account is deleted. We do retain personal information from closed accounts in order to comply with law, prevent fraud, assist with any investigations, and take other actions otherwise permitted by law.

Changes to this Privacy Policy

We may make changes to this Policy from time to time. We will notify you of substantial changes to this Policy either by posting a prominent announcement on our Site and/or by sending a message to the e-mail address you have provided to us that is contained within your user settings. All amended terms automatically take effect thirty days after it is posted on the Site. We will provide you with an opportunity to reject such changes and subsequently close your account.

Spamming

We and our users do not tolerate spam. Make sure to set your Mooch notification preferences so we communicate with you as you prefer. You are not licensed to add other Mooch users, even a user who has purchased an item from you, to your mail list (email or physical mail) without their express consent. You may not use our communication tools to send spam or otherwise send content that would violate the General Terms and Conditions. We do filter and automatically scan messages before they are sent for viruses and other illegal or prohibited content but do not permanently store email messages sent through these tools.

No guarantees

While this Privacy Policy states our standards for maintenance of Data and we will make efforts to meet them, we are not in a position to guarantee these standards.  You should not expect that your personal information or private communications will always remain private. There may be factors beyond our control that may result in disclosure of data. For example, users may abuse or misuse your personal information that they collect from the Site. As a consequence, we disclaim any warranties or representations relating to maintenance or nondisclosure of Data.

Agreement

By using this Site, you are agreeing to the terms of this Privacy Policy, as posted in this area of the Site. This Privacy Policy is incorporated into and subject to the terms of the Mooch Terms and Conditions. This Privacy Policy is effective upon acceptance in registration for new registering users.
